Accusations Without Proof in America

The American Justice System holds two principles that I consider relevant to today's discussion:

  1. Innocent until Proven Guilty
  2. Guilty Beyond a Reasonable Doubt

These principles mean that guilt (not innocence) must be proven when an accusation is made and that the guilt must be proven to the extent that no reasonable doubts of the evidence or its interpretation exist in the mind of the person called to make the decision.  In other words, the burden of proof is on the accuser to establish that the guilt of the accused is clear and not that the accused must demonstrate that he is innocent.

The principles are good ones and are designed to prevent the conviction of someone based on false accusations and misapplied evidence – so long as justice is sought.

When justice is not sought, it becomes easy to turn the concepts into a mockery. Invalid evidence can be permitted and relevant evidence is rejected. This can result in the evils of the innocent being punished and the guilty set free.

This seems to be what is going on with how Christian moral teaching is being recast as bigotry today. The accusation is made that unpopular Christian teaching X is motivated by bigotry, and thus needs to be opposed. The practitioners of Christian teaching X are therefore bigots and can be ostracized, sued, prosecuted, etc.

Now if we applied the two principles of justice proclaimed by our Justice System to these accusations, we would recognize that the accusers are the ones with the burden of proof. They would have to demonstrate how the unpopular Christian moral teaching is rooted in bigotry. But that is precisely what is not done.

Take for example the Christian teaching on Marriage. The accuser makes the claim that "opposing same sex marriage is homophobia," for example. This is the point which the accuser is obligated to prove. But, instead of proving it, the accuser assumes it is proven and calls for action to be taken against the person who believes in and supports the Christian teaching on marriage – which does not accept same sex "marriage."

That's a dangerous idea. Imagine if I alleged that atheists were disloyal Americans because they could not be trusted to swear their loyalty to the country before God? I could seize on the fact of their disbelief in God and twist it to declare that because they couldn't swear sincerely before God (because they don't believe in God) that it meant they were actively disloyal towards America. Perhaps some atheists are disloyal citizens, but it doesn't follow from the fact of their rejecting oaths before God that they do so because of disloyalty. So if I were to claim, without proving, that all atheists who were unwilling to swear their loyalty before God did so out of motives of disloyalty, and got people to accept this without proof, I could bash all atheists who disagreed with my views even if they were not disloyal citizens.

People can recognize the injustice of my hypothetical (and to some extent historical) example above. But what is not apparent to many is that this is exactly the charge leveled against Christians who stand up for their beliefs today. It is assumed that Christians who stand up for the moral teaching of the Church do so with the motivation of intolerance. Since intolerance must be oppressed, says the unqualified statements of today, Christian teaching must be opposed. But when we look at the accusation, it doesn't hold together.

Q: Why is Christian teaching on marriage intolerant?

A: Because it rejects the legitimacy of same sex "marriage."

Q: Why is rejecting the legitimacy of same sex "marriage" wrong?

A: Because it is intolerant.

That's called Arguing in a Circle. The point to be proven (that opposition to same sex "marriage" is intolerant) is assumed to be true when the truth of the point is exactly what is under dispute.

The fact is, a thing can be opposed for many different reasons and not all of them are based on bigotry. Yes, the Westboro Baptists practice a hateful form of bigotry in their actions of opposing homosexual acts. But that's not the only motivation for opposing them. The entirety of Christians who believe that homosexual acts are wrong can only be condemned for holding the Westboro position IF, and only IF, the entirety of these Christians have the same views as the Westboro Baptists.

But in fact, the Westboro Baptists and their "God Hates F*gs" signs come nowhere near the teaching of the Catholic Church which decrees in the Catechism:


2357 Homosexuality refers to relations between men or between women who experience an exclusive or predominant sexual attraction toward persons of the same sex. It has taken a great variety of forms through the centuries and in different cultures. Its psychological genesis remains largely unexplained. Basing itself on Sacred Scripture, which presents homosexual acts as acts of grave depravity, tradition has always declared that “homosexual acts are intrinsically disordered.”142 They are contrary to the natural law. They close the sexual act to the gift of life. They do not proceed from a genuine affective and sexual complementarity. Under no circumstances can they be approved. (2333)

2358 The number of men and women who have deep-seated homosexual tendencies is not negligible. This inclination, which is objectively disordered, constitutes for most of them a trial. They must be accepted with respect, compassion, and sensitivity. Every sign of unjust discrimination in their regard should be avoided. These persons are called to fulfill God’s will in their lives and, if they are Christians, to unite to the sacrifice of the Lord’s Cross the difficulties they may encounter from their condition.

2359 Homosexual persons are called to chastity. By the virtues of self-mastery that teach them inner freedom, at times by the support of disinterested friendship, by prayer and sacramental grace, they can and should gradually and resolutely approach Christian perfection. (2347)

So, the Catholic who behaves like a member of the Westboro Baptist Church is acting against Catholic teaching in behaving unjustly. It's one thing to say:

2363 The spouses’ union achieves the twofold end of marriage: the good of the spouses themselves and the transmission of life. These two meanings or values of marriage cannot be separated without altering the couple’s spiritual life and compromising the goods of marriage and the future of the family.

The conjugal love of man and woman thus stands under the twofold obligation of fidelity and fecundity.

…and therefore reject sexuality being used outside of this context (it also rejects adultery, fornication, prostitution, mistresses, masturbation, divorce and remarriage, etc.)

It's quite another thing to say that we may do harm to those people with same sex attraction. The Catholic defense of marriage has nothing to do with the thugs out there who beat up people with same sex attraction. In fact, we condemn such behavior. It doesn't seek to deny that people with same sex attraction the same human rights others have. We say such behavior cannot be considered marriage.

We believe sexual relations can only be legitimately used in the concept of marriage between one man and one woman. We stand firm on this in the face of the polygamist, the adulterer, the fornicator and others. Even if they believe their behavior to be acceptable, we must say it is not.

However, we reject any claim that our beliefs are made out of malice or hatred for others, and we hold that no person can prove that our beliefs do have this malice and hatred. A just society will stop trying to persecute people for holding to our beliefs on the basis of a person claiming without justification that we act out of hatred.

Umm, Religious Freedom is Not Just Freedom From Being Jailed…

According to Title VII of the 1964 Civil Rights Act…

SEC. 2000e-2. [Section 703]

(a) Employer practices

It shall be an unlawful employment practice for an employer -

(1) to fail or refuse to hire or to discharge any individual, or otherwise to discriminate against any individual with respect to his compensation, terms, conditions, or privileges of employment, because of such individual’s race, color, religion, sex, or national origin; or

(2) to limit, segregate, or classify his employees or applicants for employment in any way which would deprive or tend to deprive any individual of employment opportunities or otherwise adversely affect his status as an employee, because of such individual’s race, color, religion, sex, or national origin.

According to the definitions in Title VII

The term “religion” includes all aspects of religious observance and practice, as well as belief, unless an employer demonstrates that he is unable to reasonably accommodate to an employee’s or prospective employee’s religious observance or practice without undue hardship on the conduct of the employer’s business.

What seems to follow from this, as I see it, is that our religious beliefs in faith and morals cannot be used as grounds for limiting our advancement, firing us or refusing to hire us because our religious beliefs require us to hold that marriage can only exist between one man and one woman, for example.

What this tells us is the current argument used by some is invalid. Our religious freedom rights are not merely referring to not being jailed for our beliefs. Neither the government, nor the employer, nor the union organizations can discriminate against us for our beliefs.

According to law, our freedom of religion – which affects all areas of our lives – cannot be used as a basis for ostracism. We're allowed to vote according to our beliefs. We're allowed to donate to political causes according to our beliefs. We're allowed to call for legislation which is in keeping with our beliefs. We can't be fired or demoted or harassed for our beliefs.

Of course, the question of Quis custodiet ipsos custodes (Who polices the police?) comes up here. Yes, according to law, we can't be persecuted for our beliefs. But in practice, we are. The mobs who call for people to be boycotted or fired because of their religious beliefs get away with it. Companies cave in. Judges enact unjust rulings. Politicians enact unjust laws. All in the name of "tolerance."

The only problem is, this behavior sanctified by the label of "tolerance" is remarkably similar to kinds of infamous injustice: Dred Scott, Plessy v. Ferguson, Roe v. Wade etc. in which people could point to Supreme Court rulings and declare that what they did was legal.

This is what happens when the elites of a society, political and cultural, become corrupted and seek to benefit their own views and use positions of authority to hinder or harm those they disagree with. This is the kind of system where we need to stop thinking "Democrat or Republican" or "Liberal or Conservative" and start electing people who think in terms of "is this true or not? Is this just or not?"

Otherwise our claims to freedom in America are a sham.

On Westboro Baptists and the Guilt By Association Fallacy

The news reports are coming out that the founder of the infamous Westboro Baptist Church (hereafter referred to as WBC) has died. While I pray for his soul as I would for any person who lived in error, I certainly cannot praise his "mission."

I'm sure that may surprise some. The media, over the past few years have consistently placed stories of WBC antics in the news whenever Christians have spoken against government attempts to redefine marriage.   It comes across as an Orwellian Two Minute Hate, trying to link Christian moral teaching with extremist hatred.

This is the Guilt by Association fallacy, which argues:
■ It is pointed out that unsavory person A accepts claim X.
■ Therefore X is false.

The point is, the truth or falsity of a belief is not nullified by the character of the person or group that holds it. It is quite possible that a person can hold a true belief for a false reason or go to an unjust extreme in applying the truth,  but that false reason or that unjust extreme does not mean Claim X is false.

The majority of Christians who recognize homosexual acts are contrary to God's will also reject the extremist views of the WBC.

Consider the signs carried by the WBC.  Now consider what the Catechism has to say:

Poisoning the Well: "Religious Discrimination" Laws

The American media is portraying the recent bills in Arizona and Indiana concerning the freedom of religion as "religious discrimination" laws.  Thus, before anyone begins to research what the law is trying to achieve, they are given a negative image of what the law does.

In logic, we call this "Poisoning the Well."  Basically this involves:

1) Negative claim made about Subject X
2) Therefore any defense made by or concerning X is rooted in this negative claim.

In America today we are seeing anyone who remains faithful to the Christian belief that marriage is intended to be between one man and one woman is labeled homophobic or intolerant, and any attempt to legally defend this is presumed to be rooted in homophobia or intolerance.

It's dishonest behavior used to propagandize. What's alarming is currently we have the government and the mainstream media using this tactic to prevent the freedom of religion in areas they disapprove of.

Now of course any proposed law should be carefully drafted to avoid abuses. However, the basic premise of such laws is that no person should be forced to act in such a way that obligates them to do what they believe is evil. That's also the basic premise behind the Freedom of Religion in the First Amendment.

For the media and government to call these principles "religious discrimination" does not bode well for the Freedom of Religion in America.

Pro-Choice to do What?

As we witnessed the annual March for Life this past week, I keep seeing one argument pop up over and over by those who defend that travesty of justice called the "right" to abortion. That argument is "I'm not pro-abortion, I'm pro-choice."

To which, I reply: "The choice to do what?"

Because the answer is, "to have an abortion," we can see that the argument of "I'm not pro-abortion, I'm pro-choice," is essentially trying to hide behind semantics in the hopes of saying what it is less blunt, perhaps as a way to soothe a troubled conscience by using a euphemism.

The tactic is similar to the dispute over slavery. The Southern desire for secession was paraded in the name of "States Rights."

Which again brings up the question: "The state's right to do what?"

Well, it was over the state's right to determine the legality of slavery... something we know today is reprehensible.

The euphemisms "pro-choice" or "states rights" make a declaration... that the thing defended is something which can be legitimately chosen without being declared illegal.

So, in terms of the euphemism "states rights," it is argued that the state can decide whether or not whether people who are non-white can be owned as property... no other body can decide it is never right and forbid it by law.

Likewise, with the euphemism "pro-choice," it is argued that an individual alone can decide whether or not an unborn child will live or die, and no other body can forbid it by law.

The problem is, these euphemisms ignore the fact that there was (in the case of states rights) and is (in the case of pro-choice) a dispute over whether any individual or group has the power to deny the human rights to another person or group.

Once upon a time, people believed that because some human beings had a darker skin color, they could be denied human rights and treated as property.

Today, some people believe that because some human beings are unborn, their mothers can decide to deliberately kill them.

When you strip away the euphemism and rhetoric, that is what the propaganda of "I'm not pro-abortion, I'm pro-choice" actually means.

The sooner we realize this, the sooner we can recognize the ugly truth hidden behind delicate language.

Pro-Choice to do What?

As we witnessed the annual March for Life this past week, I keep seeing one argument pop up over and over by those who defend that travesty of justice called the "right" to abortion. That argument is "I'm not pro-abortion, I'm pro-choice."

To which, I reply: "The choice to do what?"

Because the answer is, "to have an abortion," we can see that the argument of "I'm not pro-abortion, I'm pro-choice," is essentially trying to hide behind semantics in the hopes of saying what it is less blunt, perhaps as a way to soothe a troubled conscience by using a euphemism.

The tactic is similar to the dispute over slavery. The Southern desire for secession was paraded in the name of "States Rights."

Which again brings up the question: "The state's right to do what?"

TFTD: Relativism In Space (or In Space, Nobody Can Hear You Reason)

In watching or reading modern science fiction, there seems to be a trend where more "enlightened" aliens rebuke people of Earth for their narrow views on morality. They point out that their own values are different, and ought to be respected, because all morality is subjective.

The irony is, these "enlightened" aliens seem to have no respect for the values of the people of Earth.

Essentially, these aliens are saying, "Your views are subjective.  Ours are objective."

But since the aliens are arguing that values are subjective, they contradict themselves...

...or rather, the scriptwriters do. Since when this kind of dialog is used, it's basically pushing a moral relativity and portraying it as an objective good that only backwards people oppose.

What's overlooked is the fact that if all values are relative, there's nothing wrong with with these "Earth values," and nothing right about "alien values" of relativity.

You Can Only Push So Far

Introduction

I'm sure A&E was caught by surprise by the huge backlash involving Phil Robertson and his comments on homosexuality.  They assumed people would agree with them in condemning his comments as "homophobic." Instead, they found that not only were a large portion of the viewing public not offended by his statements, they were in fact offended by the A&E suspension.

Those who were caught by surprise shouldn't be. While the case was an unexpected rallying point, the treatment of Christian moral teaching by political, cultural and media elites has been so hostile that it was only a matter of time before American Christians got so fed up that they would revolt.

What This Article Is Not

I don't intend this article to be a defense of Mr. Robertson. Nor do I intend it to be an apologia for the Christian position on homosexuality.  I don't intend to defend all forms of Christianity. Because I recognize Catholicism as the Church established by Christ, the positions I choose to defend come from Catholicism. When other denominations diverge from Catholicism, I feel no need to justify that position.

What this is article is about is the distorted way Christian moral teaching is portrayed.

The Hypocrisy Problem

One problem is that in America, the political, cultural and media elites have contempt for the Christian moral teaching that they run afoul of. They're perfectly happy to point out when conservative thought runs afoul Christianity... or when they think it runs afoul of Christianity. However, when the teaching of Christianity turns to things the elites practice or support, suddenly they are hostile and Christianity is "forcing" itself on others.

This is a case of hypocrisy of course. One can be consistent either by accepting the teaching of Christianity in all areas of life or one can say it has no say in any area. But if a person only permits Christianity in areas one agrees with and denied it the right to speak on position one disagrees with, it makes that person hypocritical. This is because the person only recognizes authority when it benefits them and ignores it when it does not.

The case of Pope Francis demonstrates this.  He has spoken about upholding Catholic moral and social teaching. But the elites only cite passages when it seems to agree with them... regardless of how out of context they have to take his statements.

The Honestly Problem

Another problem is the portrayal of Christian teaching.  Basically the Christian is represented as being ignorant, dishonest or holding malice because they hold to their moral beliefs which say some acts are never good. If a Christian thinks homosexual acts are sinful, it must mean the Christian hates homosexuals.

The problem is, the charge is false. The concern for another on the grounds that he or she is living in a way that leads to damnation is not an act of hatred or contempt. If we hated the sinner (and remember Christians know they themselves are sinners as well), we'd just ignore them satisfied with the thought they'd go to hell.

The Reaction

Christians get annoyed like other people of course. In this case we are annoyed because the Christians are being slandered. Our teachings are selectively cited, misrepresented and we are falsely accused of malice for our motives.

So when this attack on Robertson happened, when Christian teaching is portrayed as something it is not, Christians justly get angry.  It's not that Phil Robertson is a person of great significance.  It's that he said what was true and he was reviled for saying it.

Imposition of Ideology, Not Neutrality

Introduction

One of the tactics used in seeking to displace Christianity is by making the alternative view seem to be neutral in the face of a "partisan" religion. Basically, the argument is that because the First Amendment forbids "establishment of religion," and Christianity is a religion, the First Amendment forbids the establishment of Christianity.

The problem is, the establishment of religion refers to the making a religion the official religion of the nation. In historical precedent, a state religion involved official sanction of one religion over another. It had the rights while any other religions were restricted in some way.

This understanding has been perverted into the sense that the practice of religion cannot be accepted on property belonging to government whether national, state or local... even to the extent that a memorial to the war dead which bears a religious symbol can be ordered torn down decades later.

The Contradictory Positions

Paradoxically, one cannot place a cross on public property as part of the freedom of religion, but one can burn a cross on public property as part of the freedom of speech (if not done to intimidate)... even though both freedom of religion and freedom of speech are part of the First Amendment.

This leaves us with a contradiction: One cannot have a display of religion on public property because it might offend those who do not share those religious beliefs. So why can people air political beliefs on public property without concern over whether it offends those who do not share that belief?

If allowing religious symbols or activity on public property means the establishment or endorsement of religion, then it follows that allowing political activity on public property is the government's endorsement of a political faction. Any political demonstration on the Washington Mall therefore imposes political views.

One can either argue that both religious and political symbols/activity can be allowed on public property or neither can, but one can't argue for one without the other without being hypocritical.

Oh wait... the First Amendment also informs us that we have the "the right of the people peaceably to assemble," so one can't argue neither is allowable.

The Real Issue

The real issue here is the modern movement to restrict religion is not based on neutrality, but on restricting something that stands in opposition to an ideological position. It is an imposition of a position favored by political and social elites and the suppression of those that disagree.

In other words, what we have is the "prohibiting the free exercise" of religion in order to benefit a group that dislikes the calling of sin a sin.

When we see judges determine that so-called "gay marriage" is a human right against the widely recognized knowledge that marriage is between one man and one woman, we see a member of the elite imposing their views on others. When we see government officials refusing to defend just laws they disagree with, they are imposing their views on others.

The Reverse is Not True

Now some try to argue that Christianity is the one that imposes its view on others. This is false. Christianity is no ideology trying to force its way by courts and executive orders into a system of beliefs held across time and geography. Christian morality has long been recognized as being true by people of different lands and eras, and the laws which derive from Christian morality come from the conviction that laws must be in accordance with the truth.

This is important to remember: Christianity did not force itself on an unwilling public by unscrupulous judges and partisan laws. It is now under attack because malcontents dislike being opposed in their desire for their favorite vices.

Conclusion

Despite the media and political propaganda to label Christian morality as intolerant and calling for a "neutral" view, we need to recognize that the views expressed as an alternative are not neutral. They are adversarial to Christianity, thinking of it as a bad thing that needs to be contained or destroyed.

The secular rejection of Christianity is not a movement based on justice, but on partisanship. Once we recognize this we can see their actions for the injustices they are.

Propaganda vs. The Church

Cardinal Dolan remarked that the Church was outmarketed on the so-called "gay marriage" issue and caricatured as being "anti-gay."  While I agree, I think it is more accurate to say the opponents of the Church used massive propaganda and slander/libel in their marketing of homosexuality and abortion.

This propaganda and slander involves portraying their own position as true without proving it so, and then vilifying anyone who disagrees making them appear to be motivated by bigotry.

It has been quite successful. Looking at comments in news stories about the ACLU suing the Catholic bishops on their abortion directive, I see hateful comments about how the Church is a horrific institution that needs to be destroyed.

Now one needs to take Internet comments with a grain of salt. How representative they are of the population is hard to judge. Are they the common view? Or are they snarky teens mad that mom and dad made them go to Church?

However, such comments show that among part of the population people have been effectively propagandized to support, or at least not care, if the Government should try to attack or control the Church.

Basically the propagandists state (without proof) that the Catholic position is based on hatred and seek to use the appeal to emotion in order to get pity for the favored view and opposition to the Church teaching... before the Church can even speak.

Now some have blamed the bishops, saying that if they were doing their jobs we wouldn't be in this position. I don't believe that. The reason is,  a false statement (whether deliberate or not) can easily fit on a slogan or soundbite. The refutation takes much longer.  Given how short a news story is, the refutation is usually ignored or distorted.

However, all Catholics (not just the bishops and priests) are called to defend the faith. Not all who have been propagandized are extreme. Some of them may be open to the truth, merely believing what they have been told about us because it never occurred to question the reliability of the reports.

Some, especially on the Internet, may be abusive.  All we can do is to be polite and speak to the reader, not get sucked into a flame war with an abusive person.

Propaganda

I came across an article while checking out the news this morning. Basically it involves people who have gotten a so-called "gay marriage" in one state and wants a divorce in a state that does not recognize such relationships as marriage.

What struck me as I read this was the rhetoric used by the proponents of this "gay marriage."  The statements like:

"[T]o be in a state that doesn't recognize you as a human being, or recognize you for who you are, for who you love, it's hard... I'm not treated like the neighbors next door. I'm treated like a second-class citizen."

...show the propaganda against the reality of marriage being between one man and one woman... portraying it as looking down on people with same sex attractions.

In logic, we call this the Straw man fallacy.  The caricature of an argument which is attacked to make it seem as though the whole position is without merit.  Supporting traditional marriage is not to refuse to recognize a person with same sex attraction as a human being.  Nor is it treating them as a second class citizen.

Rather it is based on the fact that the family which raises children is the building block which society is based on. It is where the child is instilled with the teachings enabling them to build up society.

Reduce marriage to sex and emotional bond and you're destroying that building block. But you don't hear that or other reasons as to why same-sex couples can't be married.

Instead, we get appeals to pity... "the mean state (or Christians) treat us as less than human second class citizens just because we love each other."

That is biased, misleading language used to promote a political cause or point of view... the definition of Propaganda.
