When Partisanship Replaces Justice

In the 1888 encyclical Officio Sanctissimo, Pope Leo XIII encouraged Catholic participation in the legal system to change unjust laws. Part of this document asserts:

[12] Effectively the laws give Catholics an easy way of seeking to amend the condition and order of the State and to desire and will a constitution which, if not favourable and well-intentioned towards the Church, shall at least, as justice requires, be not harshly hostile. It would be unjust to accuse or blame any one amongst us who has recourse to such means, for those means, used by the enemies of Catholicity to obtain and to extort, as it were, from rulers laws inimical to civil and religious freedom, may surely be used by Catholics in an honourable manner for the interests of religion and in defence of the property, privileges, and right divinely granted to the Catholic Church, and that ought to be respected with all honour by rulers and subjects alike.

I’m struck by differing assumptions compared to the American experience of the last few years. Courts strike down laws passed to defending moral rights, The government vetoes or ignores laws they swore to uphold (without suffering repercussions for dereliction of duty). In fact, executive orders and judicial diktats deny believers the right to promote laws benefiting the common good, and target them for refusing to accept the moral changes the political and cultural elites impose on society.

Leo XIII wrote this to the Catholics in Bavaria during the Kulturkampf encouraging them to use the same system to lift oppression that their opponents used to impose it. That says something ironic about America today. That irony is America today is less just in some legal structures than Imperial Germany was 120 years ago! When legal structures are unjust we can no longer rely on our checks and balances to defend the rights of citizens who hold views unpopular with political and cultural elites.

This shouldn’t surprise us. Americans have an ugly habit of setting aside their system of justice when they deem a targeted group unworthy under the law. The obvious example is that of slavery and segregation. But we could also include the violations of treaties with Native Americans, the Internment of Japanese Americans, the denial of the rights of the unborn, and the targeting of refugees. When Americans want to stop treating a disliked group as an equal, we enforced our laws arbitrarily and passed new laws pushing the disliked group further away. 

To defend injustice, America invokes hypothetical extreme cases and treats that extreme case as the norm. For example, abortion for the rape victim, or security from possible fifth columnists, terrorists or felons in the case of Japanese internees, Islamic refugees and illegal aliens. America justified segregation on the grounds that African Americans could not adapt to “White Society” and slavery on the grounds that slaves could not adapt to freedom. Nobody asks whether extreme cases are real and whether they justify these actions.

Today, America uses the irrelevant analogy fallacy, drawing attention to a few similarities between scenarios and ignoring the greater differences. Promoting “same sex marriage,” elites claim denying people with same sex attraction the right to marry is the same as denying interracial marriage. Elites invoke the similarity of “denying two people the right to marry” and name themselves foes of bigotry. The forgotten difference is interracial marriage still involves one male and one female. Opposing interracial marriage denied something essential (complementarity of male and female) in favor of something accidental (the ethnicity of the male and female).

The same happens in other cases. Elites justify abortion by arguing the fetus is a "clump of cells,” so we can excise like any other group of cells. The essential difference is the fetus is a separate person, not a mere clump of cells, and we cannot treat a person like any other “clump.” Elites justify the “contraception mandate” by saying women have a “right” to contraceptives. Even barring the fact that Catholics reject that premise, a “right” to something does not mean people must subsidize it.

These examples show how elites set aside justice and law when it benefits their ideology, invoking them only when favorable. This results in a system where the preference of the elite is law, despite what actual law and moral belief of citizens hold. They succeed because they use simple slogans in supporting their own positions and attacking their opponents. Refuting inaccurate slogans takes longer than reciting them. People remember the inaccurate slogan longer. “War on women.” “Freedom to love.” “Reproductive Freedom.” Few know refutations exist for each of them.

This reality frustrates many Christians. People ignore truth and favor slogans.  So we offer simplistic solutions in exchange. “We need better Popes and bishops.” “We need stronger teaching.” “We need simpler explanations.” These aren’t solutions. They’re just opposing slogans.

What we need—if you’ll pardon me for using a slogan myself—are “boots on the ground.” We need Christians in every walk of life explaining what we believe and why it is good. This isn’t going to change people like flicking a switch. Many will ignore us. Many will treat us hostilely. Yet, some will hear. What we say might turn out to be a planted seed. We don’t know if the seed will bear fruit, only God knows the answer to that question. Either each one of us sows the seeds in the face of opposition, or we abandon the Great Commission and surrender the nation to those who oppose truth and righteousness.

Truth and Its Counterfeits

The World vs. The Church

The West, being effectively apostate, preaches a counterfeit message of love and salvation which claims that because God loves, He does not judge. Therefore , they think, the Church goes against God when she insists that some behavior is morally wrong. Such a mindset looks at Catholic moral teachings and thinks there is no reason to continue to cling to them. So, when the Church says that a valid marriage exists until the death of one of the spouses, says that abortion is never justified, says that marriage can only exist between one man and one woman, people get offended at the Church’s “intransigence” (one wonders why nobody ever uses that term about those who challenge the Church) and call her unreasonable, bureaucratic, intolerant, and so on. These are ad hominem attacks and not rebuttals, but they are repeated so often that many people believe it.

But the Church, believing God exists and has set down commandments regarding our moral obligations, cannot accept such a view. She recognizes the fact that God created humanity with free will—something He will not violate—and individuals can and do use their free will to reject the moral obligation that goes along with God’s loving and salvific act. Essentially, to accept God’s salvation is to accept His commandments. As the Catechism says:

678 Following in the steps of the prophets and John the Baptist, Jesus announced the judgment of the Last Day in his preaching. Then will the conduct of each one and the secrets of hearts be brought to light.583 Then will the culpable unbelief that counted the offer of God’s grace as nothing be condemned. Our attitude about our neighbor will disclose acceptance or refusal of grace and divine love.585 On the last day Jesus will say: “Truly I say to you, as you did it to one of the least of these my brethren, you did it to me.” (1470)

679 Christ is Lord of eternal life. Full right to pass definitive judgment on the works and hearts of men belongs to him as redeemer of the world. He “acquired” this right by his cross. The Father has given “all judgment to the Son.” Yet the Son did not come to judge, but to save and to give the life he has in himself.588 By rejecting grace in this life, one already judges oneself, receives according to one’s works, and can even condemn oneself for all eternity by rejecting the Spirit of love. (1021)

If Our Lord chose to die for us so that we could be saved, what will happen to those who refuse to accept this gift, or treat it cheaply?

The World vs. Reality

This rejection does not have to be an overt rejection of everything good and decent in the world. It can be as simple as refusing to accept the reality of what God has commanded and the Church teaches. For example, in the Robert Bolt play, A Man For All Seasons, St. Thomas More is beginning to experience the hostility of refusing to go along with accepting King Henry VIII in his attempts to divorce his wife and marry Anne Boleyn. More's wife, Alice, is angry and worried about the possible effects of his refusal to go along with the king’s divorce and remarriage:

Alice: (irritation) And you stand between them!
More: I? What stands between them is a sacrament of the Church. I’m less important than you think, Alice.

The hostility directed at St. Thomas More and the Catholic Church is not due to intransigence on the part of the Church or individuals. It is due to the fact that the reality of the situation does not allow them to do anything else, even if it it means facing hostility and suffering. as a result.

This forces the individual to make a choice. When the world says there is nothing wrong with X, and the Church says X is a sin, the question that must be asked is how we are so confident that the Church must be wrong—especially when we are individually so uninformed about Church teaching as to think that the words of the Pope or the Catechism or the Second Vatican Council are a change from previous teaching. Before one can condemn the Church teaching, a person has to ask whether they fully know and understand the teaching or not. If they do not, they must not presume to judge.

The World Fails to Consider the Truth of What It Does Not Want to Hear

Unfortunately, many people either judge something without learning about it or else only read about it after they have made up their minds on the subject. If one decides “The Church must be wrong,” and reads what the Church has to say on the subject with that mindset, such a person—and not the Church—is guilty of intransigence. Ultimately, what it comes down to this. A good person—one who wills to do good to the best of their ability—has to start by looking for the truth. Ideas must be examined to see if they are true or whether there are some valid objections against them. However, when there are objections, one has to see whether they have accurately represented the view they oppose or whether they have turned it into a caricature. Refuting a caricature is not a refutation of the argument.

Since the rejection of the Church can only be legitimately done by refuting what she truly believes—not a caricature of that belief—the person who opposes the Church teaching has to show how her actual teaching is wrong before his accuser can say that the Church has been refuted. But the fact is, the Church has never been truly refuted. There have only been misrepresentations of Church teaching which have been refuted. Whether that misrepresentation is by portraying the bad behavior of a member of the Church as a teaching of the whole or whether it is falsely alleging that the Church “worships statues,” or calling her moral teaching on sexuality “a war on women” or “homophobic,” all we have are straw men (misrepresentations of the truth) and ad hominem attacks. Either the teaching itself or the motive for the teaching has been misrepresented so as to lead one to believe we are a dangerous group who seek to oppose freedom and goodness out of malice—charges we deny and reject.

Ultimately, a person of good will who seeks to do what is right must begin with no longer believing what “everybody knows,” and instead checking to see if the things which were long assumed on the basis of being told by another person are actually true. If it turns out such things are not true, such a person must stop repeating them and believing them. We must seek to find and once we do find, we must change our ways to live according with the truth. If we do not, our blindness is willful and we will be judged for our hard hearts.

Dark Times: Reflections on Anti-Religious Propaganda

12 The wicked plot against the righteous 

and gnash their teeth at them; 

13 But my Lord laughs at them, 

because he sees that their day is coming. 

14 The wicked unsheath their swords; 

they string their bows 

To fell the poor and oppressed, 

to slaughter those whose way is upright. 

15 Their swords will pierce their own hearts; 

their bows will be broken. [Psalm 37:12-15]

Reading the news, it seems that the foes of the Church have largely abandoned the pretense of trying to separate Pope Francis from the teaching of the Church. Because they believe that victory is imminent, they now write as if the Church is defeated and needs to change and get with the program if she would survive. However, we refuse to roll over and submit, and this angers those who hate us. The thing is, people who oppose the teaching of the Church are not satisfied with having usurped the legal power to implement what they desire. Rather, they want everyone to accept their desires as morally good. But as long as we’re here to remind them that God exists and their behavior separates them from Him, we are a stumbling block to their plans. So, they hope that they can drive us into irrelevancy by silencing us and persuading people to come over to their side. 

They do this through both overt attacks to drive us out of the public square and through persuading individuals that it is better to follow them than to follow the Church. But they can’t do this by giving their position and letting each person decide what is true. They have to misrepresent our beliefs to make them seem dangerous and malicious. They have to make it appear as if it is the Church who is trying to force changes, when the Church is simply insisting that the truth remains true, regardless of culture or era.

Dr. Peter Kreeft shows the problem in one of his Socratic Dialogue books:

Libby: It sounds like sour grapes to me. You’re complaining because we’re winning.

‘Isa: No, I’m complaining because you’re lying. For a whole generation now you small minority of relativistic elitists who somehow gained control of the media have been relentlessly imposing your elitist relativism on popular opinion by accusing popular opinion—I mean traditional morality—of elitism, and of imposing their morality! It’s like the Nazi propaganda saying Germany was victimized by Poland.

The political and cultural elites of our nation have portrayed the situation as if a group of antisocial misfits suddenly appeared in society with the intention to persecute people who think differently than they do. They portray it as if “enlightened” people are finally throwing off the shackles of these misfits and benefitting society in doing so. So they tell the world that Christians “condemn” because we hate—that we hate and fear anyone who will not submit to what we say. They dredge up the behavior of the worst history has to offer and portray it as if this was the norm for what we would do if they let us get away from it. Basically, the lie they use is to say that the world was as enlightened as the 21st century until religion—especially Judaeo-Christian religion—came into being, and sought to control human thought through fear and superstition.

This is, of course, false. But it is quite effective. Look at modern programs on TV. Look at how they portray religion. Practitioners of religion fall into two groups. Either they are cold, hostile people who are bigoted and hostile to anyone who thinks differently, or they are willing to compromise their beliefs to get along with the world. The former are villains and the latter are heroes.

They tried to fit Pope Francis into this mindset. They took his words out of context and tried to make it seem as if he was “heroically struggling” to bring the Church into an “enlightened” view. But he had too much to say in defense of the family and Catholic teaching to spin. Now they either ignore him or lump him in with those who they once contrasted him against. Now the media has to look to individual Catholics who rebel against the authority which Christ gave His Church and portray them as the enlightened ones. The ultimate result of this distortion of the Pope was not the changing of Church teaching, but deceiving many hitherto faithful Catholics into questioning or rejecting his authority as the successor to St. Peter, wrongly thinking that the Pope is in the camp of the compromisers.

At this time, the elites of our nation seem to think they have won. The Church is on the defensive while the courts seem willing to give them everything they ask for, ignoring the fact that these rulings violate the beliefs that our nation was founded on—that the government does not have the right to compel a person to do what their religious belief forbids them to do.

So, it is indeed a dark time. But we need to remember we cannot give up in despair or simply hunkering down in a bunker, deciding to survive while the whole world goes to hell. There have been dark times before, where the state wrongfully sought to usurp authority by making laws it had no authority to make. Yes, things can indeed get worse. We can indeed be personally targeted by unjust laws or even physical persecution. But we have to remember that this is not the first time such dark times have happened. In every other time, the Church continued to stand up and perform the mission Christ gave us.

People may hate us for telling them the truth, showing them that their chosen actions are not compatible with the love of God. But they are not our enemies, but our patients. God doesn’t want them damned, but wants them to turn back to Him. Our task is to cooperate with that great commission, regardless of whether the world wants to hear it or not.

TFTD: They Revile What They Do Not Understand

But these people revile what they do not understand and are destroyed by what they know by nature like irrational animals. (Jude 1:10)

A couple of days before Christmas, I was involved in a combox discussion on the issues over the satanic counter to the Nativity Scene in Florida. My own thesis was that the putting up a “religious” display with the intent of protesting religious displays was a self-contradiction. What struck me was a comment from one of the atheists. It was a tu quoque claim that the Bible was full of contradictions. Today, there seems to be a lot of atheists on Facebook and in the comboxes bashing Christianity over Neil deGrasse Tyson and his tweet in celebration of the December 25th birthday of Sir Isaac Newton (the actual tweet struck me as being more pathetic than offensive, apparently trying to imply Newton was more important than Christ).

Basically, the theme is that Christians are stupid for believing in God while blaming Christianity and religion in general for every crime in the history of humanity (denying the role of the atheistic ideology in the worst atrocities of the 20th century). These things are pretty tiresome, and fairly frustrating. The bashing is basically illogical and factually wrong. They would actually be easy to refute—if people took the time to listen and investigate whether what they say is true.

Ven. Fulton J. Sheen expressed things very well when he wrote:

“There are not over a hundred people in the United States who hate the Catholic Church. There are millions, however, who hate what they wrongly believe to be the Catholic Church—which is, of course, quite a different thing.” (Radio Replies vol. 1)

Ven. Archbishop Sheen makes a good point. The Catholic Church is not really hated for what she teaches, but for what people think she teaches, and when people run afoul of the Church teachings, we are told that these teachings were made out of hatred of women, of people with same sex attraction, of divorced people, the poor, the rich, sexuality etc., simply because we have a teaching on the morality of certain actions.

People don’t even ask what we teach, let alone why we teach it. People assume that the worst possible portrayals of the Church in history are true, never realizing that even in past centuries there were people with ideologies and axes to grind who had no problems denigrating the Church to build up their own agendas. Because they know nothing of Catholic teaching and history, but assume the Church is capable of the worst, they assume that the horror stories they hear must be true and done out of sheer malice—never mind facts and the context of the times.

Sometimes I wish people couldn’t post on a subject online unless they could demonstrate they understood what they were bashing.

But we shouldn’t expect that. Our Lord did warn us that we could expect hatred from the world if we sought to be faithful to Him:

18 “If the world hates you, realize that it hated me first. 19 If you belonged to the world, the world would love its own; but because you do not belong to the world, and I have chosen you out of the world, the world hates you. 20 Remember the word I spoke to you, ‘No slave is greater than his master.’ If they persecuted me, they will also persecute you. If they kept my word, they will also keep yours. 21 And they will do all these things to you on account of my name, because they do not know the one who sent me. 22 If I had not come and spoken to them, they would have no sin; but as it is they have no excuse for their sin. 23 Whoever hates me also hates my Father. 24 If I had not done works among them that no one else ever did, they would not have sin; but as it is, they have seen and hated both me and my Father. 25 But in order that the word written in their law might be fulfilled, ‘They hated me without cause.’ (John 15:18-25)

So we endure hatred and try to reach out to the person of good will who wants to learn the truth, praying for all of them.

TFTD: The Chilling Imposition of Ideology

I came across an article today: "Catholic profs told to report opposition to 'gay marriage' as harassment :: Catholic News Agency (CNA),” that is troubling in one sense, and downright chilling in another sense. The troubling sense of the article is that a Catholic university (Marquette) has had a training session which tells them to report opposition to so-called “same sex marriage” as “harassment.”  The article reports a spokesman from Marquette as saying:

Brian Dorrington, senior director of communications at Marquette University, told CNA Nov. 21 that the university requires all employees, faculty, staff and student employees, to complete an anti-harassment module “in accordance with federal law and university policy,” He added that harassment training “includes the latest changes in law, and workplace diversity training reflects developing regulations.”

He said the presentation uses “hypothetical scenarios” are “teaching tools do not necessarily equate to university policy.”

Given that the Church condemns sexual acts outside of the marriage of one man and one woman as morally wrong, the fact that a Catholic university has given such a training session to be morally troubling.

However, while troubling (a Catholic university should bear witness to the truth despite what people say), this is not what makes it chilling.

What makes it chilling is the fact that this university believes it has to do this to be in compliance with EEOC regulations and court decisions that decree that the belief in marriage being between one man and one woman is “discriminatory.” Apparently, the government sees this belief, expressed publicly, is considered harassment. In other words, to publicly express that a thing is morally wrong is speech which can be targeted. As the program states:

“Although employees have free speech rights under the United States Constitution, in academic and other workplaces those rights are limited when they infringe upon another person’s right to work in an environment free of unlawful harassment.”

Of course, the person who thinks they should be allowed to work without having their religious beliefs attacked aren’t covered. The rights of the atheist to mock Christianity in a university is widespread. But the rights of the Christian to say, “This is wrong,” are blocked.

So, it’s a “right” that is similar to the sentiment expressed in George Orwell’s Animal Farm: "All animals are equal, but some animals are more equal than others."

if someone dislikes what you have to say, you can’t say it—so long as what you say goes against the favored ideologies. So, you’re free to bash religion in public, but presumably a Catholic in a Catholic institution could be accused of harassment for quoting the Catechism of the Catholic Church when it states:

2357 Homosexuality refers to relations between men or between women who experience an exclusive or predominant sexual attraction toward persons of the same sex. It has taken a great variety of forms through the centuries and in different cultures. Its psychological genesis remains largely unexplained. Basing itself on Sacred Scripture, which presents homosexual acts as acts of grave depravity,141 tradition has always declared that “homosexual acts are intrinsically disordered.”142 They are contrary to the natural law. They close the sexual act to the gift of life. They do not proceed from a genuine affective and sexual complementarity. Under no circumstances can they be approved. (2333)

2358 The number of men and women who have deep-seated homosexual tendencies is not negligible. This inclination, which is objectively disordered, constitutes for most of them a trial. They must be accepted with respect, compassion, and sensitivity. Every sign of unjust discrimination in their regard should be avoided. These persons are called to fulfill God’s will in their lives and, if they are Christians, to unite to the sacrifice of the Lord’s Cross the difficulties they may encounter from their condition.

2359 Homosexual persons are called to chastity. By the virtues of self-mastery that teach them inner freedom, at times by the support of disinterested friendship, by prayer and sacramental grace, they can and should gradually and resolutely approach Christian perfection. (2347)

Our teaching says we cannot mistreat a person—treat him or her as less than human—just because he or she has a same-sex inclination, but that doesn’t mean we have to accept such behavior as morally indifferent. But apparently, speaking out on what is right counts as “unlawful harassment."

What it boils down to is that we no longer have the freedoms of the First Amendment. We have preferred ideologies which are free to say what they want, and unpopular beliefs which will not be tolerated when they speak against the preferred ideology.

That’s kind of troubling. One thinks of how Brendan Eich was forced out of Mozilla because he privately supported the defense of marriage against redefinition by a donation. Mozilla suffered no repercussions for their action, even though Eich’s action was in no way a violation of Mozilla policy. But, on the other hand, a Catholic parish is being sued because they terminated an employee for publicly flaunting their defiance of Church teaching. One wonders if, by 2016, Google (which runs the Blogger sites) might decide that the blogs which speak in a way they disapprove of can be removed because they promote “discrimination.” Perhaps not, but it is part of the same principle—if speech our political and social elites dislike can be labelled “unlawful harassment,” then the limits to what they can get away with are few.

That’s a real problem. Such policies violate freedom—which America is supposed to be based on—in several different ways, but because the targets are unpopular with the cultural elites, they can get away with it..

In terms of the Freedom of Religion, Catholics believe that the Church is given the mission by Christ to preach the Gospel to all nations. This includes teaching about sin and the need for repentance. We cannot be forced to do what we think is evil and we cannot be forced by the government to teach only what they want us to teach. The Constitution, in this respect, recognizes that the government does not have the right to make such demands on a person. But more and more often, we are seeing the government decree (or permit lawsuits) that do make such demands, while denying the rights of the Christians to live as they believe they ought—particularly if they run a business.

In terms of Freedom of Speech, we are seeing amazing hypocrisy. Christians in America are constantly being told that if we don’t like something, just ignore it. But when others hear Christians say or do things they dislike, we’re told to cease and desist. There’s no freedom of speech there. At a bare minimum, we can say, either give us the same freedoms that our critics possess or give them the same restrictions they give us. Otherwise, there is no freedom.

Our rights to petition the government peaceably for grievances are being denied. When we enact laws which promote the shared values of a majority of citizens, the result is unelected courts overturning the laws they dislike—not by a blind equality for both sides, but by an unequal favoritism towards some views.

Now, it is disappointing that Marquette went along with this policy, instead of standing up for what was right. But let’s remember that the symptom of Marquette reflects the real problem—that publicly expressing what we believe is right means we can suffer legal penalties for being obedient to Christ in a way that even the most indifferent person should recognize is a right the Constitution promises and the government ignores.

When Christianity Stands Against Favored Causes

 

Introduction

The foundation of America was based on the premise that no person was naturally superior to another and that no group could coerce a person or group to do something they believed was evil. Of course, this premise also presumed some common sense responsibilities as well. If you believed a group believed the wrong thing (for example, believed that a religion taught error), you didn’t try to force that group to change because they had rights too. You simply didn’t associate with that group (either by leaving it or not joining it in the first place), and you used reason and politeness to explain the truth as you understood it, recognizing this as a civilized exchange that led to a greater understanding of what was true.

That’s not the case nowadays. Today we have favored causes and favored classes whose beliefs are given special treatment, imposed on all at the expense of those groups who believe they are wrong. It doesn’t have to be this way of course. It is possible that even if one way of thinking is recognized by a majority of a nation, that the minority can practice their beliefs without being hindered by the majority—provided they do not do harm on others. But that isn’t the way things are here in America. Here we take the all or nothing approach where if something is deemed favored, all must accept it.

Right now the denigrated class is Christianity—specifically Christianity which insists on moral values that the state has no right to alter. This is the belief in God who encounters the human person individually and as a group and teaches them the right way to live, and what acts are not compatible with this belief. It is reasonable that an institution that is established by a Christian denomination (like a University or a Hospital) will be run in accordance with the beliefs of this denomination and it will not act contrary to these beliefs. It is also reasonable that an individual who belongs to a religion (and takes it seriously) and owns a business will not run his business in opposition to what he believes. So a customer or an employee who wants a service which runs contrary to the religious beliefs of the employer should either do without or go to where the service can be provided—so long as it is not harmful to others. Otherwise that customer or employee is trying to violate the civil rights of the employer.

Now, if an employer does not have a philosophical basis, then the beliefs of the employee do not matter, and it would be unjust to take action against them because they hold a belief.

The History of Racism and Its Misapplication By Weak Analogy

The problem we have in America that is we have a legacy in this country of racism. It formally (that is, enshrined in law) extended from the founding of the country to the passage of the Civil Rights Act, and informally (that is, held by individuals and some groups, but not recognized as acceptable government policy) even today. It was an ugly legacy with dehumanizing slavery and then attempts to keep an ethnic group separate and oppressed. Most people today recognize it was a shameful part of our history.

Unfortunately, Americans have a habit of using the fallacy of weak analogy which looks at two events and assumes they are identical when the differences are actually more significant than the similarities. For example, some have actually tried to argue that the opposition to "same sex marriage" is the same as the racist laws which forbade interracial marriage and conclude that opposition to “same sex marriage” is also motivated by bigotry. The problem is, this analogy is weak because it has only one point of similarity, laws limiting who can be married, but many points of dissimilarity.

For example, the laws against racial marriage presumed that reproduction between a member of a Caucasian ethnic group and a member of an African ethnic group would end up “diluting” the “superior” Caucasian ethnic group. “Same sex marriage” cannot involve reproduction. So, right off the bat, this is a major difference. Another difference is that the shameful laws of racism in America were based on the belief that the people of African origin were less human than Caucasians, while the opposition to “same sex marriage” is based on the belief that some behaviors must never be acted on. I could go on, but these two examples show that the motivation for the two laws were entirely different. Sure there could have been people who took a moral prohibition and treated the person acting on it with hatred, but the hatred by some of people with same sex attraction did not cause the laws against “same sex marriage,” but hatred did cause the laws restricting African Americans.

The Begging the Question Leads to Self-Righteous Justification

This Weak Analogy leads to the fallacy of begging the question. This is where a proposition which needs to be proven is assumed to be true without proof. Opposition to abortion and contraception is assumed to be based on “controlling women,” when that’s the point that needs to be proven. Opposition to “same sex marriage is assumed to be based on “homophobia,” when (again) that’s the point which needs to be proven.

The Supreme Court of the United States made this fallacy when it struck down the Defense of Marriage Act (United States v. Windsor), assuming the motivation was intolerance, when that was the point to be proven. Justice Anthony Kennedy wrote, "The federal statute is invalid, for no legitimate purpose overcomes the purpose and effect to disparage and to injure those whom the State, by its marriage laws, sought to protect in personhood and dignity.” That the purpose was “to disparage and injure” is precisely what needed to be proven. Instead it was assumed to be true.

The Result Is The Attacking of Christianity For Opposing a Favored Cause

When Christianity opposes legitimizing something that is morally wrong, and that moral wrong is a favored cause, the result is that Christianity is accused of holding these views out of hatred and intolerance. Basically, the argument is:

  • Nothing Good can Oppose X
  • Christianity Opposes X
  • Therefore Christianity is Nothing Good.

The problem is, the major premise (Nothing Good can Oppose X) needs to be proven, not assumed to be true. But because nobody is questioning the major premise, the conclusion is assumed to be true (falsely). This means that Christianity is viewed as a hate group that needs to be isolated from society, much as one would want to isolate a Klansman or a Neo-Nazi.

Conclusion

What we have now in America is a case where politicians and judges favor certain stances and promote them in law and judicial rulings. When they declare X good, they effectively declare those who oppose X to be enemies of the state. Because the favored causes today involve things that are morally wrong from the Christian belief, Christianity must be the enemy of the state. The problem is, the Constitution does not allow the government to decide Christianity is an enemy of the state. But so long as the branches of government set aside the Constitution to favor a cause, we can expect this attack to continue.

TFTD: The Difference Between the Honorable One and the Knave

I read in the news today that six judges in North Carolina chose to resign their position rather than violate their consciences over the judicial diktat on so-called same-sex “marriages.” They recognized that they had an obligation when it came to choosing between doing what they were obligated to do before God and saving their jobs and going along with the flow.

In contrast, during the push to legalize same-sex “marriage,” of the proponents of same-sex “marriages", whether county clerks who illegally signed marriage licenses for same-sex couples (or refused to sign normal marriage certificates), or judges who equated their political views with what was constitutional, or governors who refused their sworn duty to uphold the law and refused to defend laws defending marriage . . . not one of them chose to resign. When it came to a choice between doing what they disagreed with or resigning, these people chose to go beyond their authority instead.

That’s the difference between an honorable person and a knave. One seeks to do what is right, even at great personal cost. The other abuses their authority in order to promote a cause.

Unfortunately, the knaves do not face any consequences for their actions.

When government officials can get away with abuse of power to promote their personal agendas, that’s how corruption and loss of freedom happens.

There’s irony when the people who truly follow their consciences are considered bigots who force their views on others, while government officials can push their agendas into law and are considered defenders of freedom.

We can be pretty sure that if these judges did not resign, but stayed in office and refused to comply with the law, they would face consequences.

What Scares Me About America Today

We have in America a set of factions with the mindset that says one must tolerate views in opposition to our own—except when the view is that of the Christian view of morality. Then we are told that people have no right to impose their views on others.

This view can be summed up as, "What's mine is mine, what's yours is up for grabs." Basically, the mindset is not an appeal to mutual tolerance, but a demand for Christians to surrender their beliefs whenever a person takes offense.

Indeed, when the courts actually defend the rights of the Christian faith, the result is outrage . . . how dare that court not side with the popular movements.

Think about this for a second. What we have here is a mindset that behaves in a partisan manner, unwilling to tolerate, unwilling to let equal justice under the law be done. If a politician or a judge rules or votes against them, it is proof of their intolerance and justifies anything being done with them. If a private citizen takes a stand, that justifies anything being done against them.

This isn't cheap rhetoric here. High ranking members of the Senate are trying to overturn the RFRA and obligate religious business owners to pay for things they find immoral. Brendan Eich was "encouraged" to leave Mozilla because he made a campaign donation for the defense of marriage. We are seeing groups castigate the "Five male Catholic" members of the Supreme Court "forcing their views on others," saying they have too much power and that needs to change . . . Never mind the fact that the Constitution says in Article VI that "no religious Test shall ever be required as a Qualification to any Office or public Trust under the United States."

So the results are a foregone conclusion. More people get intimidated by these tactics and decide it is easier to stay quiet. Fewer individuals stand up for what they believe is just under the law and just go along with the flow. Then there is less resistance to the next round of demands. We've already reached a point I never expected to see in America in my lifetime. How much worse will it get?

Obviously the Catholic Church will not accept changes to what she believes Jesus Christ commands, even if some members of the Church should fall away. So then the partisans will have to make a decision. What will they do with those of us who refuse to put the state above God?

This is a dilemma that all Americans, religious or not, will have to face:

  1. If people choose to respect the rights and freedoms this nation at its founding recognized as belonging to all peoples, they have to respect that the Freedom of Religion in the First Amendment expressly forbids the infringement of the Free Exercise of religion. Thus they must accept that they cannot compel us to do that which we believe is evil.
  2. If people choose to go along with the factions insisting that their ideology trumps the rights and freedoms of those who disagree with them, then it means they tolerate a decision where these factions only respect the law when it serves them and set it aside when it doesn't.

Now remember that choosing the first option will earn you the enmity of these factions, which will YOU choose?

Most people tend to go along with option #2 . . .

. . . and that's what scares me about America today.
